RE: The tariff classification of a motorized toy from China

Dear Ms. Wang:

In your letter dated June 29, 2001, received in this office on July 3, 2001, you requested a tariff classification ruling.

A sample of the “Pooh Halloween Light Chaser” was submitted for our review. The article is a handheld, battery-operated, device that enables the user to spin the figure of a cartoon character. The character “Pooh” resembles a bear that, in this case, is outfitted in a Halloween costume depicting a jack-o-lantern. The bear is a three dimensional figure attached to a motorized handheld unit. There are three plastic flexible tubes protruding from the base where the figure and handle meet. At the ends of the tubing, tiny wheels are attached that light up when the item is turned on. In addition to lighting the wheels, the batteries cause the bear and tubing to spin rapidly, thereby, creating the effects of a circle of lights. Your sample is being returned as requested.

The applicable subheading for the “Pooh Halloween Light Chaser” will be 9503.80.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys and models, incorporating a motor, and parts and accessories thereof. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
