RE: The tariff classification of industrial disc brakes from Sweden

Dear Mr. Petkash:

In your letter dated June 27, 2001 you requested a tariff classification ruling.

Your inquiry included a sales catalog which described SKD and SKP series industrial disc brakes for braking linear or rotating movement. The SKD series brakes are hydraulic or air pressure activated disc brakes consisting of two symmetrical brake halves constructed for a brake disc thickness of 12 millimeters (an interlayer can be added to accommodate a thicker brake disc). Each brake half is supplied with two cylindrical guiding pins which transmit the tangential braking force from the brake lining to the brakes, thus dissipating radial energy and increasing disc life. Two retracting springs draw back the brake linings whenever the braking effect has been achieved. The SKP series brakes are spring applied, hydraulically released disc brakes which are similar in construction to the SKD series.

The sales catalog indicates that the SKD and SKP series of brakes are available in a variety of sizes for use in a wide range of industrial machinery, including oil drilling machinery, power generation turbines, ship propulsion systems, paper making machinery, ore grinding machinery, steel processing machinery, cranes and other material handling machinery, and wood refining equipment. According to your letter the end use of a particular brake will not be known at the time it is imported.

The applicable subheading for the SKD and SKP series of industrial disc brakes will be 8485.90.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for machinery parts, not containing electrical connectors, insulators, coils, contacts or other electrical features, and not specified or included elsewhere (in chapter 84): other: other. The rate of duty will be 3.9 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on service parts for these brakes. Your request for a classification ruling should include information describing each part, including its physical characteristics and use. When this information is available, you may wish to consider resubmission of your request. Please note that, in order to be accepted, a ruling request is limited to a maximum of five articles.
