RE: The tariff classification of a woman’s sweater and collar from Hong Kong and China

Dear Ms. Post:

In your letter dated June 22, 2001, on behalf of Express Inc., One Limited Parkway, Columbus, OH, 43230, you requested a tariff classification ruling. Your samples are being returned as requested.

You submitted a woman’s sweater with a separate cowl neck collar. The style number is 96H2105. The two items are constructed from 40% wool, 40% angora, 20% nylon, knit fabric. The outer surface of the sweater is a jersey knit fabric which measures 9 or fewer stitches per 2 centimeters in the horizontal direction. You state in your letter the sweater will be shipped, marketed and sold together with the cowl neck under one style number. The sweater features a V-neckline, long sleeves with ribbed cuffs and a rib knit bottom. The collar is formed from a seamless, tube-like fabric which completely circles the neck of the wearer. Although this fabric is also of jersey knit construction, it is made of considerably thicker yarns which gives it a very different appearance from that of the fabric of the sweater. The sweater and the cowl neck collar are classified as a set. The essential character is imparted by the sweater.

The applicable HTS subheading for style 96H2105 will be 6110.10.2030, which provides for women’s sweaters, knitted: of wool or fine animal hair: other. The duty rate will be 16.3% ad valorem.

Although the set is classified under one subheading, each item requires a separate visa. Style 96H2105, the sweater, falls within textile category designation 446. Style 96H2105, the cowl neck collar, falls in category 459. Based upon international textile trade agreements products of Hong Kong and China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be effected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
