RE: The tariff classification of a women’s robe with a matching bag and towels from Egypt

Dear Mr. Sullivan:

In your letter dated June 16, 2001, you requested a tariff classification ruling on behalf of Newport News Inc. The samples submitted with your request will be returned to you under separate cover.

Style S01-44-016 consists of a women’s robe, matching bag and three towels. All three items are made from 100% cotton terry woven fabric. The kimono styled robe extends to below the knees and features a full front opening secured by a self-fabric belt and two front patch pockets located below the waist. There is a matching fabric bag that is large enough to hold the robe when not in use. The robe and bag are considered to be a composite good as defined in GRI 3(b) with the robe imparting the essential character to the good.

The submitted towels consist of a bath towel approximately 27 by 50 inches, a hand towel approximately 16 by 27 inches and a wash cloth that is approximately 13 inches square. All four edges of the towels are hemmed and there is a border on each towel made from 100 percent rayon woven fabric.

The applicable subheading for the robe will be 6208.91.1010, Harmonized Tariff Schedule of the United States (HTS), which provides for other women’s or girls’ sleep separates: of cotton. The rate of duty will be 7.8 percent ad valorem.

The applicable subheading for the bath and hand towels will be 6302.60.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: toilet linen and kitchen linen, of terry toweling or similar terry fabrics, of cotton towels: other. The duty rate will be 9.5 percent ad valorem.

The applicable subheading for the washcloth will be 6302.60.0030, HTS, which provides for bed linen, table linen, toilet linen and kitchen linen: toilet linen and kitchen linen, of terry toweling or similar terry fabrics, of cotton. The duty rate will be 9.5 percent ad valorem.

The robe and bag fall within textile category designation 350. The bath and hand towels fall within textile category 363 and the washcloth within textile category 369. Based upon international textile trade agreements products of Egypt are currently subject to the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
