RE: The tariff classification of a briefcase, backpack/travel bag, travel bag, and computer case from Indonesia.

Dear Mr. Cassmeyer II:

In your letter dated June 22nd, you requested a ruling on tariff classification.

The samples submitted with your request consist of briefcases, a backpack and a travel bag.

Item 014121, “field armored brief” is a backpack/travel bag made of an exterior surface of sheeting of plastic and of textile material of man-made fibers. The sheeting of plastic imparts the essential character. The bag consists of a zippered main compartment that is designed to hold various personal effects and has a padded compartment that is designed to hold a lap top computer. The front exterior has a zippered auxiliary compartment that has a pouch for a CD player, a pen slot, and credit card slots. Two shoulder straps are permanently attached to the bag, which enables the user to wear the bag on one’s back.

Item 014122, “correspondence brief” is a travel bag that is made of textile material of man-made fibers. The bag has a zippered main compartment and an open pocket on the front exterior that is concealed by a front flap with a hook and loop closure. A carry handle is permanently attached to the top of the bag. The bag may also be carried by means of a detachable shoulder strap, to which a detachable cell phone case is attached. If imported separately, the cell phone case is classifiable under HTS subheading 4202.92.9026.

Item 014120, “double armored brief” is a briefcase that is made of textile material of man-made fibers. The case consists of two zippered, padded main compartments, an auxiliary zippered compartment on the front exterior, and a zippered compartment on the rear exterior. One of the main compartments is specially fitted to hold a lap top computer. However, the case is primarily designed to hold business papers and documents. The auxiliary compartment has a gusseted pocket, a pouch for a CD player, multiple card slots, and pencil slots. The case can be carried by means of a detachable shoulder strap, to which a detachable cell phone case is attached, or by the carry handle on the top of the bag. If imported separately, the cell phone case is classifiable under HTS subheading 4202.92.9026.

Item 014119, “single armored brief” is a computer carrying case, made of textile material of man-made fibers, that is specially shaped and fitted to hold a lap top computer. The case consists of a zippered main compartment that is designed to hold a lap top computer and computer accessories. There is an auxiliary pocket on the front exterior that has a gusseted pocket, a pouch for a CD player, pen slots and card holders. A zippered pocket is incorporated on the rear exterior. The case may be carried by means of a top carry handle, or by a detachable shoulder strap, to which a detachable cell phone case is attached. If imported separately, the cell phone case is classifiable under HTS subheading 4202.92.9026.

The applicable subheading for #014120 will be 4202.12.8030, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity casesattache cases, brief casesof man-made fibers. The general rate of duty will be 18.3 percent ad valorem.

The applicable subheading for #014122 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bagsof man-made fibers, other. The general rate of duty will be 18.3 percent ad valorem.

The applicable subheading for #014119 will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity casesother, of man- made fibers. The general rate of duty will be 18.3 percent ad valorem.

The applicable subheading for #014121 will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, other. The general rate of duty will be 20 percent ad valorem.

Items classifiable under HTS subheading 4202.12.8030, 4202.92.3031, and 4202.92.9026 fall within textile category designation 670. Based upon international textile trade agreements products of Indonesia are currently subject the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.
