RE: The tariff classification of a woman’s tank top and a pair of women’s trousers from Hong Kong.

Dear Mr. DeVitto:

In your letter dated June 14, 2001, you requested a classification ruling for women’s tank top and trousers on behalf of Telluride Clothing Company. Samples were provided and will be returned, as you requested.

Style CDG-041 consists of a tank top and a pair of trousers. Both garments are constructed from 100% cotton knit fabric. The tank top has a U-shaped neckline in front and back; 1-½ inch shoulder straps; a small embroidered palm tree just below the neckline in front; and a plain hemmed bottom. The pull-on trousers have an elasticized waistband with a drawstring, and hemmed leg openings.

The applicable subheading for the trousers of style CDG-041 will be 6104.62.2011, Harmonized Tariff Schedule of the United States (HTS), which provides for women's knit trousers of cotton. The rate of duty will be 15.4 percent ad valorem.

The applicable subheading for the tank top of style CDG-041 will be 6109.10.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for women's knit tank tops of cotton. The rate of duty will be 17.8 percent ad valorem.

The trousers of style CDG-041 fall within textile category designation 348; the tank top of style CDG-041 falls within textile category designation 339. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
