RE: The tariff classification of dog treats from China.

Dear Ms. Borges:

In your letter, dated June 5, 2001, you requested a classification ruling.

The merchandise, “Paws ‘N More!” brand “Doggie Dough Treats,” item 24596, is comprised of dog treats in the form of dough. The dough is packed in a cylindrical, plastic container (measuring 2 3/8 in diameter and 2 5/8 inches in height.) and it comes with a plastic mold (resting in the lid of the container). The mold can be used to shape the dough in the form of a frog. The ingredients are wheat flour, water, glycerin, corn starch, poultry fat (preserved with mixed tocopherols), natural flavoring, propylene glycol, aluminum sulfate, sodium chloride, calcium chloride, liquid smoke, calcium propionate, and sodium benzoate. The product contains by weight 28 percent moisture, 6 percent protein, 4 percent fat, and 3 percent crude fiber. The net weight is 5 ounces.

The applicable subheading for dog treats will be 2309.10.0090, HTS, which provides for preparations of a kind used in animal feeding, dog or cat food, put up for retail sale, other. The rate of duty will be free.
