RE: The tariff classification of Christmas stockings from China.

Dear Ms. Weinberg:

In your letter dated May 18, 2001, on behalf of your client Team Beans, L.L.C., you requested a tariff classification ruling.

You have submitted three samples of Christmas stockings that are identified as Beans-001. The Christmas stockings are composed of a plush textile fabric. Each stocking has a loop for hanging. The turned down cuff will contain the name of a professional sports team or a university in recognition of baseball, football, hockey, motor sports and colleges. On each side of the name are two red and white-stripped candy canes, decorated with holly leaves and berries. A red bow is attached to the front of the cuff and snowflakes are scattered over the body of the Christmas stockings.

Your letter of inquiry states that the Christmas stockings will be imported in several sizes: mini, medium and large. The mini Christmas stocking is approximately 4 inches high and features the words “Red Wings” on the cuff. The body of the stocking features the logo of the “Red Wings” National Hockey League team.

The medium Christmas stocking is approximately 10 inches high and has the word “Yankees” on the cuff. The body of the stocking has the “NY” and the “Baseball Yankee logo with the Uncle Sam top hat”.

The large Christmas stocking is approximately 13-1/2 inches high and has the word “Michigan” on the cuff. The body of the Christmas stocking features the “Big M” logo for the University of Michigan.

The samples are returned as you requested.

The applicable subheading for the three styles of Christmas stockings mentioned above, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
