RE: The tariff classification of fruit and vegetables in vinegar from China.

Dear Mr. Raagas:

In your letter dated May 11, 2001, you requested a tariff classification ruling.

A sample, an ingredients breakdown, and illustrative literature accompanied your letter. The sample was forwarded to the U.S. Customs laboratory for analysis. Item FV 202216 Chili Star Fruit Vinegar contains tightly packed chili peppers and star fruit in a liquid medium of distilled white vinegar, citric acid, salt, sodium sulfate, sodium benzoate, and potassium sorbate, put up in a clear glass bottle. Laboratory analysis found the product contained 3.6 percent acetic acid. The vinegar is a product of the United States, the chili pepper, star fruit, and the other ingredients are products of China.

The applicable subheading for Item FV 202216 Chili Star Fruit Vinegar will be 2001.90.6000, HTS, which provides for vegetables, fruit, nuts and other edible parts of plants, prepared or preserved by vinegar or acetic acidotherother. The rate of duty will be 14 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
