RE: The tariff classification of unfinished decoratve ceramic collector plates from Europe.

Dear Mr. Burke:

In your letter dated May 16, 2001, on behalf of The Edwin M. Knowles China Company, you requested a tariff classification ruling.

The samples submitted consist of the following unfinished ceramic plates of porcelain:
item number 136, which is a coupe-shaped plate measuring approximately 8 ¾ inches long by 6 ½ inches at its widest point and featuring four pre-drilled holes on a raised back lip.
item number 148, which is an oblong-shaped plate measuring approximately 8 ½ inches long by 6 ¼ inches wide and featuring four pre-drilled holes on a raised back lip.

It is stated that after importation these plates will be subjected to a decalcomania process. This process involves applying a special decal containing artwork and firing in a kiln to permanently affix the decal to the plate. These plates which will then be sold to collectors will have wire threaded through their holes for the purpose of hanging or displaying the plates. Further, each of these decorated plates will then have a descriptive label applied to the back detailing the following: the limited edition number of the plate; its series name; and other information pertaining to its value as a collectable. This label also contains a FDA-mandated warning that states: “Not for food use. Food consumed from this plate may be harmful. Decorative art object.”

The applicable subheading for these unfinished decorative ceramic collector plates of porcelain will be 6913.10.5000, HTS, which provides for other ornamental ceramic articles of porcelain, other. The rate of duty will depend upon the country of origin.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
