RE: The tariff classification of a gift set from China

Dear Mr. Raagas:

In your letter dated May 11, 2001 you requested a tariff classification ruling.

A sample, descriptive literature, and an ingredients breakdown were submitted with your letter. The sample was examined and disposed of. Product no. SP-201883 consists of a wooden “prison box,” measuring approximately 6½ inches square by 3 inches deep, into which has been placed a bottle of stir-fry oil (a mixture of canola oil and sesame oil), a clear plastic pouch containing chili flakes, ceramic salt and pepper shakers, four wooden chopsticks, and one package of rice noodles. The set is shrink-wrapped in clear plastic.

Each component of the set will be separately classified.

The applicable subheading for the chili flakes will be 0904.20.6090, HTS, which provides for dried or crushed or ground fruits of the genus Capsicum (peppers) othernot groundother. The rate of duty will be 2.5 cents per kilogram.

The applicable subheading for the stir-fry oil will be 1517.90.2040, HTS, which provides for edible mixtures or preparations of animal or vegetable fats or oilsotherotherbaking or frying fatswholly of vegetable oils. The rate of duty will be 8 percent ad valorem.

The applicable subheading for the rice noodles will be 1902.19.2090, HTS, which provides for pasta, whether or not cooked or stuffedor otherwise prepareduncooked pastaotherexclusively pastaproduct of a country other than an EU country. The rate of duty will be free.

The applicable subheading for the chopsticks will be 4419.00.8000, HTS, which provides for tableware and kitchenware, of woodother. The rate of duty will be 3.2 percent ad valorem

The applicable subheading for the box will be 4420.90.4500, HTS, which provides for caskets and cases for jewelry or cutlery and similar articles, of woodotherjewelry boxes, silverware chests, cigar and cigarette boxes, microscope cases, tool or utensil cases and similar boxes, cases and chests, all the foregoing of woodothernot lined with textile fabrics. The rate of duty will be 4.3 percent ad valorem

The applicable subheading for the ceramic salt and pepper shakers will be 6912.00.4100, HTS, which provides for ceramic tableware, kitchenware, other household and toilet articles, other than of porcelain or chinatableware and kitchenware otherothersalt and pepper shaker sets. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
