RE: The tariff classification of preserved vegetables in glass bottles from China.

Dear Mr. Harris:

In your letter dated May 18, 2001, on behalf of Shonfeld’s (USA), Inc., you requested a tariff classification ruling.

Two samples were submitted with your letter. The samples were forwarded to the United States Customs laboratory for analysis. Products FV-201899 Chili Infused Vinegar and FV-201811 Chili Pepper Infused Vinegar consist of tightly packed, whole chili peppers in distilled white vinegar, citric acid, sodium sulfite, sodium benzoate, potassium sorbate, and salt. The peppers are packed in clear glass bottles of varying sizes and shapes. Laboratory analysis found the FV-201811 Chili Pepper Infused Vinegar contains 5 percent acetic acid and the FV-201899 Chili Infused Vinegar contains 4.1 percent acetic acid.

The applicable subheading for FV-201899 Chili Infused Vinegar and FV-201811 Chili Pepper Infused Vinegar will be 2001.90.3900, HTS, which provides for vegetables, prepared or preserved by vinegar or acetic acidothervegetablesother. The rate of duty will be 9.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
