RE: The Tariff Classification of Boys’ Cotton/Nylon Woven Ruf and Zip Off Cargo Trousers from Cambodia

Dear Mr. Lacy:

In your letter dated April 25, 2001, you requested a tariff classification ruling on behalf of Flying Dragon Garment Ltd., Phnom Penh, Cambodia.

Two samples were submitted with your request: Style Number 58227 and Style Number 58224. Style Number 58227 is a Boys’ 77% Cotton/23% Nylon Ruf Pant. This garment features a fly front; button closure at flat waistband; belt loops; two side pockets; two patch pockets in back with velcro closures; a large patch pocket with flap and velcro closure on the side of the right leg; and a large pocket with zipper closure on the side of the left leg. The hem of each leg has a drawstring closure. A textile patch with the “Sideout Boardwear” logo is sewn onto the right back pocket. Similar logos are placed on the zippered pocket and the right front leg.

Style Number 58224 is a Boys’ 71% Cotton/29% Nylon Zip-Off Cargo Pant. This garment features a fly front; button closure at flat waistband; belt loops; two side pockets; two back pockets with flap and velcro closures; a patch pocket with flap on the side of each leg; and a small pocket with velcro closure above the patch pocket on the left leg. A zipper encircles each leg allowing the long leg pant to be converted to a short pant.

Both styles are chief weight cotton. You state the pants will be imported in Boys’ size range 8-16. Both samples will be returned to you as requested.

The applicable subheading for the Boys’ Woven Cotton/Nylon Trousers, Style 58227 and Style 58224, will be 6203.42.4045, Harmonized Tariff schedule of the United States (HTS), which provides for Men’s or boys’ suits, ensembles, suit- type jackets, blazers, trousers, bib and brace overalls, breeches and shorts (other than swimwear): Trousers, bib and brace overalls, breeches and shorts: Of cotton: Other: Other: Trousers and breeches: Boys’: Other: Other. The rate of duty will be 16.9%.

The Boys’ Woven Cotton/Nylon Ruf and Zip-Off Cargo Pants fall within Textile Category Number 347. Based upon international textile trade agreements, products of Cambodia are subject to quota and the requirements of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and change. To obtain the most current information, we suggest that you check, close to the time of shipment, the U. S. Customs Service Textile and Status Report, an internal issuance of the U. S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
