RE: The tariff classification of backpacks, duffel bag, and portfolio bag from Hong Kong.

Dear Ms. Seyfried:

In your letter dated January 30th, 2001, you requested a ruling on tariff classification.

The samples submitted with your request each have an exterior surface of textile material of man-made fibers.

Style #1745 is a duffel bag with wheels and a retractable handle. The interior is secured by a zippered closure and two carry handles are permanently attached to the bag. Several zippered pockets are sewn to the exterior.

Style #1612 is a portfolio bag that is capable of holding documents and books. The interior is secured by a front flap with a hook and loop closure.

Style #1746 is a backpack with wheels and a retractable handle. The interior is secured by a zippered closure. Two shoulder straps are permanently attached to the rear and there are zippered pockets sewn to the exterior of the bag.

Style “rucksack” is a backpack with two shoulder straps sewn to the rear exterior. The interior is secured by a drawstring closure and a flap with tuck lock closures. Zippered pockets are incorporated on the exterior of the bag.

The applicable subheading for 1745 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bagsother, other, of man-made fibers, other. The general rate of duty will be 18.3 percent ad valorem.

The applicable subheading for 1746 and “rucksack” will be 4202.92.3020, HTS, which provides for travel, sports, and similar bagsbackpacks. The general rate of duty will be 18.3 percent ad valorem.

The applicable subheading for 1612 will be 4202.12.8030, HTS, which provides for attache cases, brief cases, school satchels, occupational luggage cases and similar containers, other, of man-made fibers. The general rate of duty will be 18.3 percent ad valorem.

These products fall within textile category designation 670. Based upon international textile trade agreements products of Hong Kong are currently subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
