RE: The tariff classification of a shoulder strap and a waist belt from China.

Dear Mr. Lum:

In your letter dated February 2, 2001, you requested a tariff classification ruling.

The samples submitted are a shoulder strap, item number SS-100, and a waist belt, item number ELP-100. The shoulder strap is made of two elastic fabric panels. The panels are sewn to resemble a suspender. Attached at one end of each panel is an adjustable plastic fitting and the other ends feature hook and loop fasteners. The strap is used to give added support and stability to any type of paintball backpack. The waist belt is constructed of web fabric with a plastic buckle. The waist belt is used for securing the paintball backpack at waist level.

The applicable subheading for the shoulder strap and waist belt will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
