RE: The tariff classification of an inflatable bath pillow from Taiwan.

Dear Mr. Murray:

In your letter dated December 11, 2000, you requested a tariff classification ruling.

You are requesting the tariff classification on an item that is described as an inflatable bath pillow/neck roll, item number 22724. The item is an inflatable pillow that is enclosed in a textile cover with two attached suction cups that are used to attach the pillow to the bathtub so the pillow will not slip while in use by the consumer. The importer states in the ruling request that the item may be imported to be used as a component in a gift set, or it may be sold on its own as a separate item.

The applicable subheading for the inflatable bath pillow/neck roll will be 3926.90.7500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Pneumatic mattresses and other inflatable articles, not elsewhere specified or included.” The rate of duty will be 4.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
