RE: The tariff classification of holsters from China.

Dear Mr. Stumpf:

In your letter dated November 12th, 2000, on behalf of Cascade Designs, Inc. you requested a classification ruling.

The samples submitted with your request are identified as articles one through seven. All seven items have an exterior surface of textile material of man-made fibers. Articles one through four are similar to sheaths or holsters and are designed to be used like bottle carriers. Each of the holsters has carry handles and webbing with tuck lock closures that allow for attachment to other items. The top opening of each holster is not secured by a closure. Item five is a belt bag that holds various personal items and is designed to be worn around the waist. Article six is a portable chair of cell foam covered with textile material of man-made fibers. Article seven is a travel bag that can hold a mattress to be used while hiking, but is not specially shaped and fitted.

The applicable subheading for items one through four will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcase, vanity casesof man-made fibers. The duty rate will be 18.6% ad valorem in the year 2000 and 18.3% ad valorem in the year 2001.

The applicable subheading for items five and seven will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, with outer surface of textile materials, other, other, of man-made fibers, other. The duty rate will be 18.6% ad valorem in the year 2000 and 18.3% ad valorem in the year 2001.

The applicable subheading for item six will be 9401.80.6030, Harmonized Tariff Schedule of the United States (HTS), which provides for other seats, other, other. The duty rate will be free in the year 2000 and free in the year 2001.

Items classifiable under HTS subheading 4202.92.3031 and 4202.92.9026 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
