RE: The tariff classification of shoulder protectors, a dish drainer, an etagere, a towel rack, a magazine rack, and a dress bag from China.

Dear Mr. Prackler:

In your letter dated November 15, 2000, on behalf of EZ DO Company, you requested a tariff classification ruling.

The submitted samples are as follows:

Item #00118 - shoulder protectors made of clear PVC

Item #85015 - plastic covered steel wire collapsible dish drainer

Item #31000 - “The Complete Bath” consisting of an etagere, a towel rack and a magazine rack, all made of plastic coated metal and designed to stand on the floor.

Item #11024 - “Clouds” dress bag measuring 54”L x 14”W x 20”D with a zipper down the front

The applicable subheading for the shoulder protectors will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides for ...other household articles...of plastics, other, other. The rate of duty will be 3.4% ad valorem.

The applicable subheading for the dish drainer will be table, kitchen or other household articles and parts thereof, of iron or steel, other, not coated or plated with precious metal, other. The rate of duty will be 3.4% ad valorem.

The applicable subheading for The Complete Bath consisting of the etagere, towel rack and magazine rack, will be 9403.20.0010, HTS, which provides for other furniture and parts thereof: other metal furniture, household. The rate of duty will be free.

The applicable subheading for the dress bag will be 6307.90.9989, HTS, which provides for other made up articles, including dress patterns: other: other: other... other: other. The rate of duty will be 7% ad valorem.

The aforementioned rates of duty will remain unchanged in 2001.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
