RE: The tariff classification of a flag from China.

Dear Mr. Boykin:

In your letter dated November 22, 2000, you requested a tariff classification ruling. The sample is being returned as requested.

The sample submitted is a blank flag. After importation into the United States it will be completed with grommets and printed pictures. The blank flag is made of polyester woven fabric panel. The panel is hemmed on all sides. Folding down the upper edge of the flag and hemming it has created a sleeve measuring 1-1/2 inches in diameter. This sleeve will function as the mechanism by which the flag will be hung from a pole. It measures approximately 15-7/8” x 11-13/16”.

The applicable subheading for the flag will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem. The rate of duty will remain unchanged in 2001.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
