RE: The tariff classification of a Christmas votive holder from China.

Dear Mr. Colon:

In your letter dated November 20, 2000, you requested a tariff classification ruling.

The submitted sample is identified as a Christmas votive holder, item #23000001. It is composed of 70 percent iron, 15 percent glass, 10 percent dried flowers and 5 percent pewter. This article is made by welding together the metal pieces. The square-shaped votive holder is designed with decorated Christmas trees on two sides. The opposite sides feature the outline of a reindeer. This votive candle holder measures approximately four and a half inches high by approximately four inches wide. The votive candle is placed inside the holder, when the candle is burning the light shines through, illuminating the Christmas tree and reindeer designs. The votive candle does not illuminate the area, it merely illuminates the designs of the votive holder.

The applicable subheading for the applicable subheading for the Christmas votive holder will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free.

The rate of duty will remain unchanged in 2001.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
