RE: The tariff classification of bookmarks and “larger labels” from Turkey.

Dear Mr. Tim Marks:

In your letter received by this office November 15, 2000, you requested a tariff classification ruling. The samples are being returned as requested.

The samples submitted are bookmarks and “larger labels.” The bookmarks are made of 100 percent polyester jacquard fabric panel. They measure approximately 7-1/8” x 1-1/4” and 7” x 1-1/4”.

The articles you referred to as “larger labels” appear to be miniature rugs used for decorations. They are constructed of 100 percent polyester jacquard fabric panel resembling an Oriental rug. They measure approximately 6-1/16” x 3-13/16”, 10” x 5-13/16” and 12” x 7-7/8”.

The applicable subheading for the bookmarks will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The duty rate will be 7 percent ad valorem. The rate of duty will remain unchanged in 2001.

The applicable subheading for the “larger labels”, miniature rugs, will be 6304.93.0000, HTS, which provides for other furnishing articles, excluding those of heading 9404: Other: not knitted or crocheted, of synthetic fibers. The rate of duty will be 9.8 percent ad valorem. The rate of duty effective January 1, 2000 will be 9.7 percent ad valorem.

Articles classifiable under subheading 6307.90.9989, HTS, which are products of Turkey, are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB" and then search for the term "GSP".

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
