RE: The tariff classification of a toy set from China

Dear Ms. Markey-Wohar:

In your letter dated November 16, 2000, you requested a tariff classification ruling.

Plastic toy set model no. 82103 named “Light ‘N Sound T-Ball” was submitted with your inquiry. The article is a preschool T-ball set with lights and sounds. A cylindrical stand is set on a circular base measuring 6 inches in diameter. The stand with base is approximately 8 ½ inches tall. The bottom convex base enables the T-ball stand to wobble from side to side. The stand has three visual decorative clear plastic designs embedded on one side. The clear plastic designs are each colored differently and equipped with lights. Each design symbolizes the game of baseball. Representations of a red ball, blue glove and purple cap are aligned vertical from top to bottom. A button at the base of the stand can be pressed to activate the lights and sounds. Lights and sounds are also emitted when the ball is knocked off the stand. The ball is approximately 3 inches in diameter and is placed on top of the stand. The bat measures approximately 7 ½ inches long. The set has a total of 8 songs and 5 sounds. The game set is intended for children 6 months and up. Your sample is being returned as requested.

The applicable subheading for the toy set will be 9503.70.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys, put up in sets or outfits and parts and accessories thereof. The rate of duty will be free.
