RE: The tariff classification of a decorative glass article and a glass candleholder from China

Dear Ms. Liu:

In your letter dated November 9, 2000, you requested a tariff classification ruling. Two representative samples were submitted with your ruling request.

The first sample, item #W2911344, is a glass candleholder that measures approximately three and one-half inches in height and three inches in diameter at the opening. The exterior surface of the glass is completely covered with green-plaid rice paper. You indicated that the paper will come in three assorted colors.

The applicable subheading for the glass candleholder will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent ad valorem.

The second sample, item #W2911342, is a decorative six and one-half inch square tray-shaped glass stand. There are four – two and one-half inch supports (one on each corner) attached to its base. The item is composed of four frosted glass panels designed with a silver metal leaf motif. The panels flare out from a clear glass bottom.

You indicated that the unit value of the glass stand item will be $4.80. The applicable subheading for the decorative glass stand will be 7013.99.8000, HTS, which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes: other glassware: other: other: valued over $3 but not over $5 each. The rate of duty will be 12.8 percent ad valerem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
