RE: The tariff classification of a men’s knit warm-up suit from Pakistan.

Dear Ms. St. Peter:

In your letter, dated October 27, 2000, you requested a tariff classification ruling on behalf of H-Spider, Inc. As requested, your sample will be returned.

The submitted sample is a warm-up suit which is identified by the Style code “HS”. The warm-up suit consists of a pullover top and a pair of pants. Both garments are constructed from 100 percent acrylic, finely knit fabric that is napped on the inside surface. The pullover top features a hood with a drawstring; long sleeves with rib knit cuffs; a kangaroo pocket below the waist; and a rib knit waistband. The pants feature a self-fabric tunnel elastic waistband with an inner drawstring; two quarter side pockets; and tunnel elastic cuffs at the ankles.

The applicable subheading for the pullover top will be 6112.12.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for: Track suits, ski-suits and swimwear, knitted or crocheted: Track suits: of synthetic fibers: shirts: men’s or boys’. The rate of duty will be 28.9 percent ad valorem.

The applicable subheading for the pants will be 6112.12.0050, Harmonized Tariff Schedule of the United States (HTS), which provides for: Track suits, ski-suits and swimwear, knitted or crocheted: Track suits: of synthetic fibers: trousers: men’s or boys’. The rate of duty will be 28.9 percent ad valorem. The pullover top falls within textile category designation 638 and the pants fall within textile category designation 647. Based upon international textile trade agreements, products of Pakistan are subject to visa requirements and quota restraints.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
