RE: The tariff classification of garment weight, PU coated, oxford weave textile fabric, of a kind used in the outdoor recreational industry, etc., from Thailand.

Dear Mr. Hizon:

In your letter dated June 28, 2000, you requested a classification ruling.

The instant sample, identified as style #6845 and burgundy in color, consists of a 100% nylon oxford weave fabric (210D x 420D/68 x 45, 60" wide) composed of filament yarns that has been visibly coated on one side with a clear (not pigmented as described in your correspondence) polyurethane plastics material. While this coating is clear, it is in sufficient amount to be visible to the naked eye, especially in the interstices of the weave. You provided the following weight specifications for the material:

Wt. of fabric: 4.40 oz/ y² (84%)
Wt. of coating: 0.97 oz/y² (16%)
Total wt.: 5.37 oz /y² (100%)

The New York Customs laboratory analyzed the instant sample and made the following determination:

Wt. of fabric: 152.4 g/m² (91%)
Wt. of coating: 14.8 g/m² ( 9%)
Total wt.: 167.2 g/m² (100%)

The applicable subheading for material will be 5903.20.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for textile fabrics impregnated, coated, covered or laminated with plastics, with polyurethane, of man-made fibers, not over 70 percent by weight of rubber or plastics. The duty rate will be 7.9 percent ad valorem. Effective January 1, 2001, the duty rate will be 7.8 percent ad valorem.

There are currently no textile restraints for this merchandise.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
