RE: The tariff classification of a woman's jacket from Taiwan

Dear Ms. Walker:

In your letter dated November 1, 2000, you requested a classification ruling.

The sample submitted, style number 16-F101, is a woman's hip-length jacket. The jacket is constructed of a shell composed of an outer layer of a woven 100% cotton denim fabric and an inner layer of a knit berber 55% acrylic/45% polyester fabric which you indicated in a telephone conversation are joined by an adhesive.

The jacket has a stand up collar, a full front opening that is secured by a zipper closure, two front pockets with zipper closures at the waist and an inner pocket. The shell fabric has been folded over at the top edge of the collar, at the wrists and at the bottom hem to expose the knit berber fabric on the outer surface of the jacket giving the illusion of trim. The knit berber fabric has also been folded over and exposed to resemble trim along the seams on the garment's sleeves, surrounding the armholes, and along the front and rear panels.

The sample is being returned to you.

The applicable subheading for the jacket will be 6202.92.2061, Harmonized Tariff Schedule of the United States (HTS), which provides for other women's anoraks, windbreakers and similar articles, of cotton. The duty rate will be 9.1 percent ad valorem

You also requested the classification of two additional garments, style numbers 16-F101A and 16-F101D, which you indicate are composed of different fabric configurations from the sample jacket. We cannot classify these garments without the submission of samples for our examination, due to differences which may change the classification of the garments.

The jacket falls within textile category designation 335. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
