RE: The tariff classification of conveyor rope belts for use on a GVA yarn conditioning machine, from Germany.

Dear Ms. King:

In your letter dated October 12, 2000, on behalf of American Suessen Corporation, you requested a classification ruling.

It is our understanding that there are no ongoing transactions at any ports of entry in the United States. This letter shall address itself to any future or prospective transactions.

One representative sample was submitted along with a descriptive brochure. The instant sample consists of a closed loop (endless) belt of rope. The belt, itself, is a twisted six-strand rope of cabled filament yarns of man-made fiber Nomex (a heat resistant type of nylon) that has been coated or treated with Teflon. According to a recent telephone conversation with the importer, these belts will be imported in lengths ranging from 5,000 mm to 11,600 mm. All belts, except one, are six mm in diameter; the exception is seven mm in diameter.

According to your brochure these belts will be used on a GVA yarn conditioning machine to convey carpet yarns into the heat setting chamber. This process heat sets the twist in the yarn and bulks it at the same time. As such, the machine is therefore mainly used for yarns intended for cut pile carpets (Saxony Carpets).

The applicable subheading for the product will be 5910.00.1090, Harmonized Tariff Schedule of the United States (HTS), which provides for transmission or conveyor belts or belting, of textile material, whether or not impregnated, coated, covered or laminated with plastics, or reinforced with metal or other material, of man-made fibers, other than power transmission belts and belting. The duty rate will be 5.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
