RE: The tariff classification of a textile wall hanging and table decoration from China.

Dear Ms. Pearson:

In your letter dated October 9, 2000 you requested a classification ruling.

You submitted two samples. Item T00328 is a wall hanging which consists of a heart-shaped piece of wood covered with fabric. The woven fabric is made from 60 percent polyester and 40 percent cotton. The fabric is printed with stripes and stars. The center portion of the item has a bow made from raffia and a hanging wooden star. The top portion of the wallhanging features a wire hanger with wooden stars affixed to one side. This wire is used to hang the item from a wall.

Item T07914 is a textile bunny decoration affixed to a metal stand. The bunny is stated to be made from 50 acrylic and 30 percent acrylic. This item will be made in three sizes, 8, 10 and 12 inches tall. Other versions will include a chick or duck.

The applicable subheading for the wallhanging will be 6304.93.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of synthetic fibers. The duty rate will be 9.8 percent ad valorem.

The applicable subheading for the bunny decoration will be 6307.90.9989, HTS, which provides for other made up articles, including dress patterns: other: other: other . . . other: other. The rate of duty will be 7 percent ad valorem.

The wallhanging falls within textile category designation 666. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

Subheading 6307.90.9989, HTS, is not assigned a textile category designation and items classified therein are not subject to quota or visa requirements.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
