RE: The tariff classification of Spare Tire Clamping Bow from Germany

Dear Mr. Resetar:

In your letter dated September 22, 2000 you requested a tariff classification ruling.

You submitted a diagram from your electronic parts catalog illustrating the part and its relationship to other automotive parts.

The Clamping Bow is made of steel that measures approximately 9" x 1.5" x 1". A winged head screw is inserted through a hole in the center of the Bow, through the wheel and into a threaded hole in the luggage compartment body panel. The Bow applies pressure to the spare tire rim to hold it in place against the interior body panel.

The applicable subheading for the Spare Tire Clamping Bow will be 8708.99.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts and accessories of the motor vehicles of headings 8701 to 8705: Other parts and accessories: Other: Other: Other: OtherOther. The rate of duty will be 2.5% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
