RE: The tariff classification of a candleholder from China.

Dear Ms. Aldinger:

In your letter dated September 11, 2000, you requested a tariff classification ruling.

The sample submitted is a cube-shaped transparent glass candleholder with open top, item number 995023, that measures approximately 3 inches in height by 2 ½ inches in width by 2 ½ inches in depth. The top portion of the glass holder, possessing a prominent rim, has an open top as well as a base measuring nearly 2 ½ inches by 2 ½ inches. This holder is inserted into a polyresin container, imported in four assorted colors, that measures about 3 ¼ inches in height by 3 ¼ inches in width by 3 ¼ inches in depth and features an exterior with an ornate floral motif in relief. After insertion, the top rim of the glass holder remains visible in being supported by the polyresin container’s top border.

The applicable subheading for this candleholder will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
