RE: The tariff classification of sets of infants’ woven jackets and matching woven mittens from Macau

Dear Ms. Spurbeck:

In your letter dated September 14, 2000 you requested a classification ruling.

The outershell and mittens of padded style 36836 is manufactured from 55% cotton and 45% polyester. This style is characterized by long sleeves with elasticized cuffs, by a detachable hood, by an elasticized waistband, by a plastic D-ring, attached to a textile tab near the waist, which can fasten to the plastic clasp which is permanently attached to each of the mittens by means of a textile tab, by pockets at the lower front, and by a full-front, zippered opening , extending into the stand-up collar, which is covered by a textile flap, which can fasten to the body of the garment by means of metal snaps and VELCRO fasteners.

Style 37728 differs from the preceeding style by virtue of the outershell of 100% nylon and the pile fabric of man-made fibers which trims the non-detachable hood.

Style 44911 differs from the preceeding style by virtue of the outershell of 100% polyester and the pile fabric which trims the cuffs.

As you have requested, the sample garment sets are being returned.

The applicable subheading for style 36836 will be 6209.20.5050, Harmonized Tariff Schedule of the United States (HTS), which provides for babies’ garments and clothing accessories, of cotton, other, other, other, other; and for the other styles will be 6209.30.3040, which provides for babies’ garments and clothing accessories, of synthetic fibers, other, other, other. The duty rates will be 9.5 and 16.4 per cent ad valorem, respectively.

The three styles fall within textile category designation 239. Based upon international textile trade agreements products of Macau are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
