RE: The tariff classification of sun shades and a toddler chair from China.

Dear Ms. Castellanos:

In your letter dated August 24, 2000, on behalf of Tomy Corporation, you requested a tariff classification ruling. The samples are being returned as requested.

The samples submitted are car sun shades item numbers 8370 (small) and 8371 (medium), and a sit-me-up toddler chair, item number 1956. The car sun shades are used for shielding a child from the heat and sunlight while travelling in a car. They are made of knit mesh fabric panel sewn over a flexible rod. The articles feature detachable rubber suction cups which are used for attaching the articles to a car window.

The collapsible sit-me-up toddler chair is constructed of plastic material. It features web straps to secure the child and attach the article to a chair. It has a removable plastic tray. The article can be converted to a booster seat or be used to raise a child to table level or it can be used as a low chair for playtime. When not in us it can be folded into a portable size with carry handles for travel or storage.

The applicable subheading for the sun shades will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem.

The applicable subheading for the sit-me-up toddler chair will be 9401.80.4045, HTS, which provides for seats (other than those of heading 9402), whether or not convertible into beds, and parts thereof: Other seats: Of rubber or plastics: Other: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
