RE: The tariff classification of pillow covers from Pakistan.

Dear Mr. Mustafa:

In your letter dated September 6, 2000 you requested a classification ruling.

You submitted two pillow covers identified as pillow # 1 (gold color) and pillow # 2 (green color). Both covers are made from woven fabric. Pillow # 1 is stated to be composed of 50 percent silk, 45 percent acetate and 5 percent other fibers while pillow # 2 is stated to be composed of 67 percent silk, 28 percent polyester and 5 percent other fibers. Item # 1 measures approximately 16 x 18 inches. The back has an overlapping flap with a 5 button and loop closure. The front is decorated with embroidery done in metallic yarns and beads. The edges are finished with piping. The front of item # 2 features a geometric embroidered design. Added along the edges is a piece of braided cord. Each corner features a wooden bead. This cover measures approximately 17 x 20 inches. The back has an overlapping flap with a 5 button and loop closure. As requested the samples are being returned.

The applicable subheading for the covers will be 6304.99.6040, Harmonized Tariff Schedule of the United States (HTS), which provides for other furnishing articles, excluding those of heading 9404: other: other: other other: other. The duty rate will be 4.5 percent ad valorem.

The pillow covers fall within textile category designation 899. Based upon international textile trade agreements products of Pakistan in category designation 899 are not subject to quota or visa requirements.

Textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
