RE: The tariff classification of handbags from China.

Dear Ms. Meagher:

In your letter dated August 23rd, 2000, on behalf of Atlandia Imports, Inc., you requested a classification ruling.

The samples submitted with your request are handbags designed to carry money, keys, and small accessories on a daily basis.

Style G83GR, "Block Print Purse", has an exterior surface of knitted yarns of 75% rayon and 25% acrylic. The interior is lined and is secured by a full-width zippered closure and a front flap with a center button closure. A braided shoulder strap is permanently attached to the bag.

Style G91BL, "Blossom Bag", has an exterior surface of knitted yarns comprised of 100% wool. The interior is lined and is secured by a center button closure. A self-material shoulder strap is permanently attached to the bag.

Style G57BR, "Windowpane Purse", has an exterior surface of knitted yarns of 100% wool. The interior is lined and is secured by a front flap with a center button closure. A self-material shoulder strap is permanently attached to the bag.

Style G77NT, "Kokopelli Bag", has an exterior surface of knitted yarns comprised of 52% flax, 26% cotton, and 22% rayon. The interior of the bag is lined and is secured by a drawstring of self-material straps that also serve as shoulder straps.

Styles G91BL and G57BR are subject to the Wool Products Labeling Act of 1939.

The applicable subheading for G83GR will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapof man-made fibers. The duty rate will be 18.6% ad valorem.

The applicable subheading for G91BL and G57BR will be 4202.22.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapother. The duty rate will be 18.6% ad valorem.

The applicable subheading for G77NT will be 4202.22.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapof vegetable fibers and not of pile or tufted construction, other. The duty rate will be 6% ad valorem.

Items classifiable under HTS subheading 4202.22.8050 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

Items classifiable under HTS subheadings 4202.22.6000 and 4202.22.8080 fall within textile category designation 871. Based upon international textile trade agreements products of China are subject to the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
