RE: The classification of a woman’s jacket, a pair of shorts, and a pair of pants from Hong Kong and China.

Dear Ms. Hodor:

In your letter dated August 14, 2000, on behalf of your client CK Jeans Womens, you requested a classification ruling.

The submitted samples are described as follows:

You have indicated that the submitted garments are constructed from 85% cotton, 9% polyester, 5% nylon and 1% elastane woven fabric. The polyester, which is painted to create a metallic monofilament, is twisted with the nylon fibers, creating a metallic yarn that is 14% of the fabric weight.

Style #QJBM90560S – A woman’s jacket that features a shirt style collar long sleeves with buttoned cuffs, and a full front opening with a metal zipper closure. The jacket also has patch pockets at the chest, slant pockets at the waist, and a banded bottom with adjustment tabs.

Style #QJBM91508S – a pair of women’s pants that feature five belt loops, two front slant pockets and one small patch pocket, two rear patch pockets, a front zipper opening with a button closure and long hemmed leg openings.

Style #QJBM94536S – A pair of women’s shorts that feature five belt loops, two front slant pockets and one small patch pocket, two rear patch pockets, a front zipper opening with a button closure and short hemmed leg openings.

The applicable subheading for the Jacket, Style #OJBM90560S, will be 6202.92.2061, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girl’s overcoats, carcoats, capes, cloaks, anoraks, (including ski-jackets) windbreakers and similar articles (including padded, sleeveless jackets), other than those of heading 6204, of cotton, other, other, other, women’s. The rate of duty will be 9.1% ad valorem.

Style #OJBM90560S, (Jacket) falls within textile category designation 335. Based on international textile trade agreements, garments imported from Hong Kong and China are subject to a visa requirement and quota restraints.

The applicable subheading for the Pants, Style #OJBM91508S, will be 6204.62.4020, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girl’s trousers, of cotton, other, trousers and breeches, women’s, other. The rate of duty will be 17% ad valorem.

Style #OJBM91508S, (Pants) fall within textile category designation 348. Based on international textile trade agreements, garments imported from Hong Kong and China are subject to a visa requirement and quota restraints.

The applicable subheading for the Shorts, Style #OJBM94536S, will be 6204.62.4055, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girl’s shorts, of cotton, other, shorts, women’s. The rate of duty will be 17% ad valorem.

Style #OJBM94536S, (Shorts) fall within textile category designation 348. Based on international textile trade agreements, garments imported from Hong Kong and China are subject to a visa requirement and quota restraints. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
