RE: The tariff classification of a single use camera from China

Dear Ms. Parham:

In your letter dated August 11, 2000 you requested a tariff classification ruling.

The disposable camera, called the Le Clic by Keystone, contains a roll of 400-speed 35 mm color film with 27 exposures on the roll. The camera, which has a fixed focus, contains a built-in flash unit powered by a battery. The cardboard packaging indicates that the camera plus film is a single use camera that should be returned to the photographic laboratory for processing into finished prints.

The applicable subheading for the single use camera will be 9006.53.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for photographic (other than cinematographic) cameras; other, for roll film of a width of 35 mm; one time use cameras, with built-in stroboscopic flash. The rate of duty will be free.

You requested information about any prohibition or restriction on importing disposable cameras into the United States. The U. S. International Trade Commission (ITC) has issued a general exclusion order excluding from entry into the United States certain lens-fitted film packages, also known as one-time use cameras, single use cameras and disposable cameras that infringe on one or more of the patents owned by Fuji Photo Film Company, Japan. The general exclusion order was issued on ITC Investigation No. 337-TA-406. Any questions you have regarding this exclusion order should be directed to the Office of the General Counsel, U.S. International Trade Commission, Washington, D.C. 20436.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
