RE: The tariff classification of handbags from China.

Dear Ms. Pudjijanto:

In your letter dated August 11th, 2000, you requested a classification ruling.

The samples submitted with your request are identified as style numbers 899067, "active chic sling bag" and 899115, "active camera bag". Both are made of an exterior surface of 100% nylon.

Item #899115 measures approximately 6 1/2" x 7" x 2 1/4" and is padded on the interior. The interior of the central compartment is lined, has a zippered back wall pocket, and is secured by a zippered closure. There is a cell phone holder sewn to the front exterior and a shoulder strap is permanently attached to the bag.

Item #899067 measures approximately 11" x 12" x 1" and incorporates an adjustable shoulder strap. The interior of the bag is lined and is secured by a hook and loop closure. There is a removable nylon bag affixed to the interior by means of a hook and loop closure. The removable bag has an outer surface of nylon mesh, a middle layer of foam and a man-made textile fabric lining. Pursuant to General Rule of Interpretation (GRI) 3(b), the items are considered a set. The handbag imparts the essential character of the set.

The applicable subheading for #899067 and #899115 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapother, other, other, of man-made fibers. The duty rate will be 18.6% ad valorem. For entry purposes, the removable bag, part of style #899067, is classifiable under HTS subheading 4202.92.3031.

Items classifiable under HTS subheading 4202.22.8050 and 4202.92.3031 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
