RE: The tariff classification of men’s and women’s body/bath wraps from Turkey

Dear Mr. Paisley:

In your letter dated July 26, 2000, you requested a classification ruling.

Samples of a men’s and a women’s after bath body wraps were submitted. They are of woven construction and made of 100 percent cotton. The women’s wrap measures 29 by 56 inches and has Velcro straps fastened along the top of the elasticized edge of the garment. It is designed to cover the body from bodice to approximately knee length. The men’s wrap measures 22 by 52 inches and has Velcro straps along the elasticized waist to fasten the garment shut. The men’s wrap is designed to cover the body from waist to knee length. Both wraps have patch pockets.

The applicable subheading for the women’s wrap will be 6208.91.1010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s negligees, bathrobes, dressing gowns and similar articles, other, of cotton, bathrobes, dressing gowns and similar articles, women’s. The duty rate will be 7.9 percent ad valorem.

The applicable subheading for the men’s wrap will be 6211.32.0081, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments, men’s or boys’, of cotton, other. The duty rate will be 8.3 percent ad valorem.

The women’s wrap falls within textile category designation 350. Based upon international textile trade agreements products of Turkey are subject to quota and the requirement of a visa.

The men’s wrap falls within textile category designation 359. Based upon international textile trade agreements products of Turkey, category designation 359, are not subject to quota and do not require a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
