RE: The tariff classification of Globe Liquid Glucose 43 BE from Thailand

Dear Mr. DeCastro:

In your letter dated June 4, 2000, on behalf of Rokeach Food Distributors, you requested a tariff classification ruling.

Additional information was submitted in a letter dated August 2, 2000. The samples submitted with your initial request are being returned. The subject merchandise is described as Globe Liquid Glucose 43 BE. It has a minimum dextrose equivalent of 39.0. The product contains dextrose, maltose, maltotriose and higher sugars. It will be packaged in lined steel drums having a net weight of 300 kilograms.

The applicable subheading for the Globe Liquid Glucose 43 BE will be 1702.30.4040 Harmonized Tariff Schedule of the United States (HTS), which provides for Glucose and glucose syrup, not containing fructose or containing in the dry state less than 20 percent by weight of fructoseotherglucose syrup. The duty rate will be 2.2 cents per kilogram.

Articles classifiable under subheading 1702.30.4040, HTS, which are products of Thailand are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB" and then search for the term "GSP".

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
