RE: The tariff classification of yarns and fabric from Taiwan.

Dear Mr. Wang:

In your letter dated July 20, 2000, on behalf of your client, Andari Fashion of El Monte, CA, you requested a classification ruling.

You submitted four yarn samples.

Style NS-7333 is stated to be 82% cotton, 18% nylon. It is of knit construction and appears to be a loop wale yarn.

Style CHA-091 is stated to be 70% acrylic, 30% nylon. It, too, is knit and apparently a loop wale yarn.

Style CH-A020 is stated to be 100% acrylic. It is of a circular knit construction.

Style VN-030206 is a narrow warp knit fabric, approximately 5mm in width.

The applicable subheading for styles NS-7333, CHA-091, and CH-A020 will be 5606.00.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for loop wale-yarn. The duty rate will be 9.4 percent ad valorem.

The applicable subheading for style VN-030206 will be 6002.20.6000, HTS, which provides for narrow warp knit fabric. The duty rate will be eight percent ad valorem.

HTS 5606.00.0090 falls within textile category designation 201. HTS 6002.20.6000 falls within textile category designation 222. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
