RE: The tariff classification of “Karma Beans” from China

Dear Ms. Albatal:

In your letter dated July 18, 2000, you requested a tariff classification ruling.

You submitted descriptive literature and samples with your request. The merchandise in question is “Karma Beans”, your product number 54789. This consists of a plastic packet containing jelly beans, an ovoid plastic “stone” container, and a fabric drawstring pouch; all color coordinated and blister packaged together. There will be eight varieties and eight corresponding colors of “stone”, pouch, and jelly beans. The containers each have a “new age” theme word (dream, love, peace, beauty, wisdom, strength, fortune, friendship) engraved on the lid in a contrasting color, and have a motto embossed inside the bottom. The jelly beans are said to be of US origin, which are shipped and are then packaged with the other items in China.

The applicable subheading for the jelly beans will be 1704.90.3550, Harmonized Tariff Schedule of the United States (HTS), which provides for Sugar confectionery (including white chocolate) not containing cocoa: Other: Confections or sweetmeats ready for consumption: Other: OtherPut up for retail sale: Other. The rate of duty will be 5.6 percent ad valorem.

Please note that, upon compliance with the requirements of 19 C.F.R. 10.1, the candy will be eligible for duty free treatment under 9801.00.1097 HTS, which provides for products of the United States, when returned after having been exported, without having been advanced in value or improved in condition by any process of manufacture or other means while abroad.

The applicable subheading for the plastic container will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides for Tableware, kitchenware, other household articles and toilet articles: Other: Other. The rate of duty will be 3.4 percent ad valorem.

The applicable subheading for the fabric pouch will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for Other made-up articles: Other: Other: Other: Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
