RE: The tariff classification of a woman’s jacket, vest and pullover from Singapore.

Dear Ms. Girvin:

In your letter dated July 7, 2000, you requested a classification ruling. As requested, the samples will be returned to you.

You have submitted three samples. Style 009-2547, is a 94% cotton and 6% spandex knit woman’s jacket. The garment features a rib-knit crew neck, long sleeves with rib-knit cuffs, a full frontal opening with a heavy zipper closure and a rib-knit bottom. Style 009-2547 is imported in regular sizes. Style 009-2548 is identical to style 009-2547 except it is imported in petite sizes and style 009-2549 is identical to style 009-2547 except it is imported in tall sizes.

Style 009-2565, is a 94% cotton and 6% spandex knit woman’s vest. The outer surface of the vest measures more than nine stitches per two centimeters in the horizontal direction. The vest features a stand up collar, a zippered full frontal opening, oversized armholes and a straight hemmed bottom. Style 009-2565 is imported in regular sizes. Style 009-2566 is identical to style 009-2565 except it is imported in petite sizes and style 009-2567 is identical to style 009-2565 except it is imported in tall sizes.

Style 009-2554 is a 94% cotton and 6% spandex knit woman’s pullover. The outer surface of the pullover measures more than nine stitches per two centimeters in the horizontal direction. The pullover features a johnny collar, long sleeves with hemmed cuffs and a hemmed bottom with side vents. Style 009-2554 is imported in regular sizes. Style 009-2555 is identical to style 009-2554 except it is imported in petite sizes and style 009-2556 is identical to style 009-2554 except it is imported in tall sizes.

The applicable subheading for styles 009-2547, 009-2548 and 009-2549 will be 6102.20.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks anoraks (including ski-jackets), windbreakers and similar articles, knitted or crocheted, other than those of heading 6104: of cotton: women’s. The duty rate will be 16.3 percent ad valorem.

The applicable subheading for styles 009-2565, 009-2566 and 009-2567 will be 6110.20.2035 Harmonized Tariff Schedule of the United States (HTS), which provides for Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other, vests, other than sweater vests, women’s or girls’. The duty rate will be 18.2 percent ad valorem.

The applicable subheading for styles 009-2554, 009-2555 and 009-2556 will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for Sweaters, pullovers, sweatshirts, waistcoats and similar articles, knitted or crocheted: of cotton: other, other: other: women’s or girls’. The duty rate will be 18.2 percent ad valorem.

Styles 009-2547, 009-2548 and 009-2549 fall within textile category designation 335. Based upon international textile trade agreements products of Singapore are subject to quota and the requirement of a visa.

Styles 009-2565, 009-2566 and 009-2567 fall within textile category designation 359. Based upon international textile trade agreements products of Singapore are subject to quota and the requirement of a visa.

Styles 009-2554, 009-2555 and 009-2556 fall within textile category designation 339. Based upon international textile trade agreements products of Singapore are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
