RE: The tariff classification of fingertip towels and sports towels from China.

Dear Ms. Carol Mossa:

In your letter dated July 11, 2000 you requested a classification ruling.

You submitted representative samples of towels. Style numbers 6112B, 6102, 6102B and 6111 are sports towels. These towels are stated to be made from a 55 percent ramie and 45 percent cotton terry fabric. Styles 6102 and 6112B are sheared on one side while styles 6111 and 6102B feature terry loops on both sides. Style 6112B is hemmed and styles 6102, 6102B and 6111 have fringed ends. Styles 6102 and 6102B measure 13 x 18 inches and styles 6111 and 6112B measure 16 x 26 inches. One corner of all four towels features a metal grommet with a clip.

Style numbers 6101 and 6101B are fingertip towels. The towels are stated to be made from a 55 percent ramie and 45 percent cotton terry fabric. Both towels are hemmed on the sides and fringed on the ends. Style 6101 is sheared on one side while style 6101B features terry loops on both sides. The towels measure 13 x 18 inches. As requested the samples are being returned.

The applicable subheading for the fingertip towels, style numbers 6101 and 6101B, will be 6302.99.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: other: of other textile materials: other. The duty rate will be 8.8 percent ad valorem.

The applicable subheading for the sports towels, style numbers 6112B, 6102, 6102B and 6111 will be 6307.90.9989, HTS, which provides for other made up articles, including dress patterns: other: other: other other: other. The duty rate will be 7 percent ad valorem.

The fingertip towels fall within textile category designation 899. Based upon international textile trade agreements products of India in category designation 899 are not subject to quota or visa restrictions. Presently, subheading 6307.90.9989 is not assigned a textile category designation and items classified therein are not subject to the requirement of visa or quota.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
