RE: The tariff classification of stuffed toys from China.

Dear Mr. Tomenga:

In your letter dated July 5, 2000, you requested a tariff classification ruling on behalf of Simon Marketing, Inc.

The merchandise consists of five sample figures made of soft textile fabric that depict a full-bodied white cat character. The figures are about nine inches in height, wear human-like attire and are stuffed with polyester fiber. The articles are specifically described as a female cat in pink space suit with bubble (Wrin No. 02518-000A); male cat in blue space suit with bubble (Wrin No. 02518-000B); female cat in blue uniform and blue hat (Wrin No. 02518-003A; male cat in black, white and yellow uniform with blue hat (Wrin No. 02518-003B); and, female cat wearing wedding gown (Wrin No. 02518-006A). The samples are being returned at your request.

The subject articles, based on their soft construction, amusing appearance and toy attire, are toy playthings for the amusement of children or adults.

The applicable subheading for the stuffed toys will be 9503.41.0010, Harmonized Tariff Schedule of the United States (HTSUS), the provision for stuffed toys representing animals or non-human creatures. The rate of duty will be free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
