RE: The tariff classification of children’s play tents from China.

Dear Mr. Vick:

In your letter dated July 10, 2000, on behalf of The Ninja Corporation (UK) Topaz House Oldgate St. Michael’s Industrial Estate, you requested a classification ruling.

The submitted literature depicts various play tents, product numbers 2078 (“Real Pop Up Sports Combo with Target”) 2079 (“Real Pop Up Sports Combo with Basketball”), 2030 (“Bed Bug Bedtime Play Environment), 2081 (“Hollywood Home”) and 2082 (“Hollywood Garage with Tunnel”). The literature submitted states that these merchandises are for both indoor and outdoor use. Product numbers 2078 and 2079 are made of mesh fabric panels and woven fabric panels sewn over a pop-up steel frame. Product number 2078 is designed with various games activities printed on the article, a throw target, a power zone pitch ‘n’ catch and a soccer target. Product number 2079 is designed with various games activities printed on the article, a basketball hoop, power zone pitch ‘n’ catch and a soccer target.

Product number 2081 and 2082 are constructed of woven textile fabric panels sewn over a pop-up steel frame. The tents feature plastic windows, a side opening and openings large enough for a child to crawl through or for the connection of a tunnel. The tunnel is constructed of woven textile fabric sewn over a flexible rod.

Your inquiry does not provide enough information for us to give a classification ruling on product number 2030 (“Bed Bug Bedtime Play Environment”). Your request for a classification ruling should include the actual sample of the bed tent.

The applicable subheading for the product numbers 2078 and 2079 will be 9504.90.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for arcade, table or parlor games, including pinball machines, bagatelle, billiards and special tables for casino games; automatic bawling alley equipment; parts and accessories thereof: Other: Other, other. The duty rate will be free.

The applicable subheading for the product numbers 2081 and 2082 will be 6306.22.9030, HTS, which provides for tents: Of synthetic fibers: Other, other. The duty rate will be 9.3 percent ad valorem.

Product numbers 2081 and 2082 falls within textile category designation 669. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
