RE: The tariff classification of unisex hospital tops, pants, gowns and baby carrier from Pakistan.

Dear Ms. Dadson:

In your letter dated July 3, 2000, received in this office July 11, 2000 you requested a classification ruling. The samples will be returned to you as requested.

The submitted samples are a child and adult’s hospital top and a baby carrier. You also state as per our telephone conversation that knee length hospital gowns and pants will also be imported in the identical fabric composition. The hospital tops are composed of woven 55% cotton /45% polyester fabric. The hospital tops and gowns have an opening on the side with a hook and loop and self tie closure. They have a round neckline, short sleeves, and a patch pocket. The pants will have a side opening. The baby carrier is composed of woven 65% cotton/35% polyester fabric. It is designed to carry a baby on the front side of a person’s body. The item has fabric straps and plastics buckles.

The applicable subheading for the child’s hospital top will be 6206.30.3060, Harmonized Tariff Schedule of the United States (HTS), which provides for “Women’s or girls’ blouses, shirts and shirt-blouses: Of cotton: Other; Other, Other; Girls’: Other.” The duty rate will be 15.8% ad valorem.

The applicable subheading for the adult’s hospital top will be 6206.30.3040, Harmonized Tariff Schedule of the United States (HTS), which provides for “Women’s or girls’ blouses, shirtsOf cotton:Women’s.” The duty rate will be 15.8% ad valorem.

The applicable subheading for the child’s hospital pants will be 6204.62.4050, Harmonized Tariff Schedule of the United States (HTS), which provides for “Women’s or girls’ suitstrousers(other than swimwear): Trousers, bib and brace overalls, breeches and shorts: Of cotton: “Other: Other: Other, Trousers and breeches: Girls’: Other: Other.” The duty rate will be 17% ad valorem.

The applicable subheading for the adult hospital pants will be 6204.62.4020, Harmonized Tariff Schedule of the United States (HTS), which provides for “Women’s or girls’ suitstrousers(other than swimwear): Trousers, bib and brace overalls, breeches and shorts: Of cotton: Other: Other: Other, Trousers and breeches: Women’s: Other.” The duty rate will be 17% ad valorem.

The applicable subheading for the children’s and adults hospital gowns will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTS), which provides for “track suits, ski-suits and swimwear; other garments: Other garments, women’s or girls’: Of cotton: Other.” The duty rate will be 8.3% ad valorem.

The applicable subheading for the baby carrier will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other made up articles, including dress patterns: Other: Other, Other: Other.” The duty rate will be 7% ad valorem.

The children’s and adult tops fall within textile category designation 341. The children’s and adult pants fall within textile category 348 and the children’s and adult hospital gowns fall with category 359. Based upon international textile trade agreements products of Pakistan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
