RE: The tariff classification of a woman’s knit sweater of man-made fibers containing 23 percent or more by weight of wool or fine animal hair from Hong Kong

Dear Ms. Tewari:

In your letter dated June 14, 2000, you requested a classification ruling.

Style 05001R is a woman’s sweater of 43% acrylic/43% wool/14% nylon rib knit fabric constructed with fewer than nine stitches per two centimeters measured in the horizontal direction. The garment extends below the waist and features a full frontal opening with heavy zipper closure and snap closures at the neck and rib bottom; a placket which conceals the zipper and snaps; a permanently attached hood with pom-pom; extra long sleeves with rib endings; and a flapped pocket on the left sleeve with a snap.

The applicable subheading for the sweater will be 6110.30.1520,Harmonized Tariff Schedule of the United States (HTS) which provides for sweaters,pullovers,sweatshirts,waist- coats(vests) and similar articles, knitted or crocheted: of man-made fibers: other: containing 23 percent or more by weight of wool or fine animal hair,sweaters:women’s or girls’. The duty rate will be 17 per cent ad valorem.

Style 05001R falls within textile category designation 446. Based upon international textile trade agreements, products from Hong Kong are subject to quota and the requirement of a visa.

The sample will be returned.

In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
