RE: The tariff classification of Aromatherapy Ceramic Set and a box of essential oils from Indonesia

Dear Mr. Floresch:

In your letter dated June 7, 2000 you requested a tariff classification ruling.

Samples of the Aromatherapy Ceramic Set and box essential oils were submitted with your inquiry, and as requested are being returned. The Aromatherapy Ceramic Set, packed in a decorative handmade box, consists of a ceramic burner and a small bottle of rose essential oil bound by a cord. Local artists produce the ceramic burner. Three small bottles of essential oils are packed in a decorative box. The oils, jasmine, rose and cananga, are bound together with cord on a piece of bark. The ceramic burner and bottle of essential oil is considered a set for tariff purposes. The boxed essential oils are classified separately.

The applicable subheading for the jasmine essential oil will be 3301.22.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Jasmine essential oil. The rate of duty will be free.

The applicable subheading for the rose essential oil will be 3301.29.3500, Harmonized Tariff Schedule of the United States (HTS), which provides for Rose essential oil. The rate of duty will be free.

The applicable subheading for the cananga oil will be 3301.29.5050, Harmonized Tariff Schedule of the United States (HTS), which provides for Other essential oils. The rate of duty will be free.

The applicable subheading for the Aromatherapy Ceramic Set will be 6914.90.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for Other ceramic articles not of porcelain or china. The rate of duty will be 5.6 percent ad valorem

Articles classifiable under subheading 6914.90.8000, HTS, which are products of Indonesia, are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB" and then search for the term "GSP".
