RE: The tariff classification of illuminated reindeer sculptures from China.

Dear Mr. Hoffacker:

In your letter dated June 9, 2000, you requested a tariff classification ruling on behalf of your client Consolidated Stores, Inc., on four illuminated reindeer sculptures.

The samples are described as follows: Item C2-100 is a 30-inch flat plastic outline of a reindeer with electrical lights spaced equally along the outline. Items M4-200 and M4-300 are identical except for size, M4-200 stands 48 inches and M4-300 stands 57 inches. Both are standing deer, constructed of wire and outlined with miniature lights. The fourth item, M16-200 K/D grazing deer stands 48- inches and is identical in construction to the M-4 reindeer.

The applicable subheading for the illuminated reindeer sculptures will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other: other. The rate of duty is free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
