RE: The tariff classification of Christmas decorations and other articles from China.

Dear Mr. Tinelli:

In your letter dated June 12, 2000, on behalf of your client National Tree Company, you requested a tariff classification ruling.

You have submitted a sample of an 18” Christmas stocking that is identified as item #S-TRD-18STSG. Two samples of 72” by 13-1/2” table runners identified as item #S-DS-72TRHG and item #S-TRD-72TRRd were also submitted. You have also submitted literature depicting mantle swags, Christmas tree skirts and Christmas bottle covers. Your letter states that all of the above mentioned samples are made of man-made fiber fabrics.

The samples are returned as you requested.

The applicable subheading for the table runners will be 6302.53.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: other table linen: of man-made fibersother. The rate of duty will be 11.9 percent ad valorem.

The applicable subheading for the mantle swags will be 6304.93.0000, HTS, which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of synthetic fibers. The rate of duty will be 9.3 percent ad valorem.

The applicable subheading for the bottle cover bags will be 6307.90.9989, HTS, which provides for other made up articlesother: other: other. The rate of duty will be 7 percent ad valorem.

The table runners and mantle swags fall within textile category designation 666. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

The applicable subheading for the Christmas stockings and the Christmas tree skirts will be 9505.10.2500, HTS, which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
